Starbucks does not want its brand to be Caged Womenassociated with weed, which is unfortunate seeing as their distaste for the drug comes at the expense of a totally sweet bong.
The coffee giant has successfully won a copyright infringement lawsuit over a bong that resembles the classic Starbucks Frappuccino cup. The contraption, dubbed the Dabuccino, features clear glass for the chamber, a green mouthpiece that mimics a straw and a logo that resembles the Starbucks siren, except with pot leaves as a headdress.
SEE ALSO: Caffeinabis: If Starbucks sold weedIn two separate lawsuits, Starbucks held the website Hitman Glass company and bong designer James Landgraf liable for "trademark dilution, trademark infringement and copyright infringement." According to Eater, the product “willfully intended to create an association with the Starbucks Marks and to capitalize upon the success and popularity of the Starbucks Marks to sell [their] products.” The suit also claims this “has caused and will continue to cause irreparable injury and damage to Starbucks Corp.’s business, reputation, and goodwill.”
Starbucks demanded that both Hitman Glass and Landgraf hand over profits from the bongs and pay for damages in fees.
“We are pleased with the court’s decision,” Starbucks said in a statement. “Starbucks has made significant investments to develop our brand and intellectual property over the past 45 years. We have an obligation to protect our intellectual property from infringement in order to retain our exclusive rights to it.”
Vice notes that Starbucks won a separate lawsuit against the bong designer James Landgraf in a default judgement, which means that Landgraf did not appear in court or to a summons as scheduled, landing Starbucks an automatic win in the suit. He owes the coffee giant $410,580.
The suit with Hitman Glass is still ongoing.
